## In short

Report the claim fast, document everything, and get every decision and estimate in writing. State law sets deadlines for the insurer to acknowledge, decide and pay; when they slip, or the amount is too low, send your own estimates, then file a complaint with your state insurance department, which is free and is what triggers enforcement. For a dispute about the amount of a covered loss, most policies allow appraisal, but you pay your own appraiser and half the umpire. After a storm, do not pay a contractor up front, do not sign blank contracts, and never sign your insurance check over to a contractor.

## How complaints work in this industry

- Insurance is regulated by the states, so the complaint goes to your state insurance department. In California, file at insurance.ca.gov or call (800) 927-4357; the department says formal consumer complaints are required before it can take direct enforcement action. - Texas: if you believe an insurer treated you unfairly, file a complaint with the Texas Department of Insurance or call its Help Line at 800-252-3439 (8 a.m.-5 p.m., Monday-Friday). [TDI: if your insurance isn't paying enough](https://www.tdi.texas.gov/tips/disagree.html)
- Deadlines are set by state law. In Texas, the insurer has 15 business days to acknowledge a claim, then 15 business days after it gets what it needs to accept or deny, may extend by 45 days if it says why, and must pay within five business days after agreeing to pay. A rejection must give the reason in writing. [TDI: getting your claim paid](https://www.tdi.texas.gov/tips/getting-your-insurance-claim-paid.html)
- In Florida (statute as of 2026), a property insurer must acknowledge claim communications within 7 calendar days, inspect within 30 days after receiving proof-of-loss statements, and pay or deny within 60 days after notice of an initial, reopened or supplemental claim. - Complaints can lead to penalties. After a market conduct examination of State Farm General's Los Angeles wildfire claims found 398 violations in 114 of 220 sampled claims, California filed an accusation that also counts 34 violations based on consumer complaints; penalties can reach $5,000 per violation, or $10,000 if willful, after a hearing. ## Your leverage

- Appraisal settles disputes about the amount of a loss: you and the insurer each hire an appraiser, the two pick an umpire, and if their estimates differ the umpire's decision binds both sides. Check your policy for the deadline to demand appraisal. [TDI: if your insurance isn't paying enough](https://www.tdi.texas.gov/tips/disagree.html)
- Back your number with documents: send the insurer supporting evidence such as a contractor's repair estimate when you dispute the adjuster's estimate, and get estimates from more than one contractor or body shop. - You choose the repair shop: in Texas you can take your car to any shop, not only the insurer's list. [TDI: getting your claim paid](https://www.tdi.texas.gov/tips/getting-your-insurance-claim-paid.html)
- A public adjuster works for you, not the insurer, but charges a fee and cannot give legal advice or take part in repairing your property. In Texas a public adjuster must have a TDI license. [TDI home insurance guide](https://www.tdi.texas.gov/pubs/consumer/cb025.html)
- Florida caps public adjuster fees at 10 percent of claim payments for claims under a declared state of emergency and 20 percent otherwise, and lets you cancel a public adjuster contract within 10 days (for emergency claims, within 30 days after the loss or 10 days after signing, whichever is longer). [Fla. Stat. 626.854](http://www.leg.state.fl.us/statutes/index.cfm?App_mode=Display_Statute&URL=0600-0699/0626/Sections/0626.854.html)
- Ask for the denial reason in writing: Texas requires it, and State Farm says it sends a letter that explains the specific policy language behind a home claim denial. ## Traps

- Appraisal is not free: you pay your own appraiser and half of the umpire's costs, and the umpire's decision is final. [TDI: if your insurance isn't paying enough](https://www.tdi.texas.gov/tips/disagree.html)
- Deadlines can stretch: a Texas insurer can extend its decision deadline by 45 days, and TDI can add 15 more days after a weather-related catastrophe. [TDI: getting your claim paid](https://www.tdi.texas.gov/tips/getting-your-insurance-claim-paid.html)
- The insurer subtracts the deductible from its payment, and you still owe it to the contractor or body shop. [TDI: getting your claim paid](https://www.tdi.texas.gov/tips/getting-your-insurance-claim-paid.html)
- A public adjuster's percentage comes out of your claim payment; ask what you will pay before you hire one. [TDI home insurance guide](https://www.tdi.texas.gov/pubs/consumer/cb025.html)
- Do not sign a repair contract with blank spaces or pay the contractor in full up front. [TDI: getting your claim paid](https://www.tdi.texas.gov/tips/getting-your-insurance-claim-paid.html)

## Scams to watch for

- Storm chasers: the FTC says to walk away from a contractor who wants cash up front, to hire only licensed and insured contractors, to get a written contract with no blank spaces, to pay by credit card or check, and to make the final payment only when the work is done. [FTC: scams after weather emergencies](https://consumer.ftc.gov/articles/how-avoid-scams-after-weather-emergencies-and-natural-disasters)
- Never sign your insurance check over to a contractor. [FTC: scams after weather emergencies](https://consumer.ftc.gov/articles/how-avoid-scams-after-weather-emergencies-and-natural-disasters)
- FEMA does not charge application fees; anyone who wants money to help you qualify for FEMA funds is running a scam. [FTC: scams after weather emergencies](https://consumer.ftc.gov/articles/how-avoid-scams-after-weather-emergencies-and-natural-disasters)
- Fake insurer phone numbers and websites appear in search results. GEICO and State Farm both warn about them; State Farm names look-alike domains such as statfarm.com. [GEICO: phishing scams](https://www.geico.com/about/fraud-awareness/phishing-scams/) [State Farm security](https://www.statefarm.com/customer-care/privacy-security/security)
- Phishing emails impersonate claims departments. State Farm says not to click links or open attachments in unexpected claim emails. [State Farm security](https://www.statefarm.com/customer-care/privacy-security/security)
- Fake agents sell policies with no real coverage and ask for cash or payment to themselves. The premium payee should always be the insurance company; check the agent's license with the state insurance department.
